At the very least, it should be a mandate that all regulations for electric personal transportation vehicles should have to be clearly stated, in one place that is clearly labeled and easy to understand. That’s a starting point. Electric PTV users shouldn’t have to search all over federal, state & local laws to find out whether or not they are being legal.
HR-727 amended the Consumer Product Safety Act, which falls under Title 15 of the United States Code, which is overall entitled “Commerce and Trade” – so it’s very clear from the context that the federal definition of “low speed electric bicycle” is intended to pertain only to commerce and trade (i.e., importing and selling) of e-bikes. HR-727 was intended to place e-bikes under the jurisdiction of the Consumer Product Safety Commission when it comes to establishing safety requirements for e-bikes imported and sold in the U.S. (as opposed to DOT or NHTSA, which handle such requirements for motor vehicles like cars and trucks). Federal law says nothing about where and how e-bikes may be ridden, thus allowing states and local jurisdictions to set their own rules.

Electric bikes (e-bikes) are very similar to regular bikes, only more fun! An e-bike has a motor and a battery that provides assistance to help the rider go further and faster. While still getting an effective work-out, you can ride up tough hills easily, enjoy long distances and have a faster commute. E-bikes are also environmentally friendly! With an e-bike, you choose your speed and assist, putting you in control of your entire ride.
Some electric bikes claim to use a neat trick called regenerative braking. If you start pedaling the bicycle or going downhill, the spinning wheels turn the electric motor in the hub in reverse and start charging up the batteries. In practice, regenerative braking is nowhere near as useful on an electric bicycle as it is on an electric train or car. An electric bike has much less mass and velocity than either a train or car, so it never gains (or loses) anything like as much kinetic energy when it starts and stops. You’d have to go down an awful lot of hills to charge up the batteries completely and that’s usually not practical. And what’s the point in pedaling the wheels simply to charge the battery? You might as well have bought an ordinary bicycle to start with!
This was my first VBT bicycling tour and it was fabulous. The bicycling was marvelous and I would recommend an e-bike to other travelers as it allowed me to ride further and with less discomfort than I would have otherwise experienced. I will definitely book another VBT tour in the near future.
Some people will want their e-bike to appear like a normal bike just to avoid any possibility of having a problem. To me, this is not needed if you are riding a street legal e-bike. But this brings up a persistent problem in some places. E-bikes that look like gasoline powered scooters. Many riders have encountered police that cannot be convinced that they can fit the legal definition for a bicycle. Whether they are bicycles or not is defined by the local motor vehicle codes. Or, they may not. In some states, there is no such thing as an e-bike defined in the codes. Either way, you can encounter police who either don’t know their e-bike law, or just ticket you because of their opinion about e-bikes that look like scooters. Cops ticket, Judges sort it out later. Looking like a normal bike and staying under the police radar can save you some If you have a scooter type e-bike, then it’s worthwhile to know the law, and possibly even carry copies of the law that makes your bike a legal bicycle.
Foldability: Not all folding e-bikes are small. Some full-size electric bikes with standard 26-inch or 27.5-inch wheels can be folded to fit into compact spaces. Make sure you’re aware of a folding bike’s weight before you buy it, though. “Foldable” doesn’t always mean light.

Speaking of Liveforphysics, riding like a hooligan can quickly get you in trouble if you ride past the police in a provocative manner. Manuevers such as the one pictured above should only be used off the road ways. Use a lot of common sense. If you are moving fast it is a good idea to be pedaling fast so you appear like you are just an athletic bicycle rider.
Whether the terrain is flat or hilly impacts the distance you can travel, as does the weight of the bike, your own weight, the gearing available on the bike, and how much juice you give it. We suggest that a distance of 10 to 20 miles is a realistic expectation. Of course, if you’re prepared to do at least some pedaling, you can extend that dramatically.
But it’s pretty easy to limit any e-bikes speed, so the e-bike could be slowed down enough to be legal in any state with a 20-MPH limit. In New Mexico though, nothing will make it a “bike” IF the motor is turned on. With the motor off, nothing prohibited carrying a motor you are not using on a “bike”. What’s the difference? You could pedal legaly on the street, then once off the street, motor happily off road.
NOTE FOR ELECTRIC MOUNTAIN BIKE RIDERS: This map represents how e-bikes are interpreted in each state’s vehicle code, and where e-bikes are allowed to go on the road, bike lanes, bike paths, or other paved or hard-surface bicycle infrastructure. The vehicle code does not apply to electric mountain bike access on motorized and non-motorized trails typically used for hiking, biking, and other singletrack or doubletrack trail experiences. eMTB access on singletrack is different than access to paved and soft surface bike lanes and bike paths; eMTBs are not allowed everywhere traditional mountain bikes are; and on federal, state, county and local trails, eMTB access varies significantly. Always consult with your local land manager for access questions.

I am trying to get a e bike (jetson electric scooter) and I live in nj and I have been reading and most of the laws state that it must be registered and insured with Lisence. I was wondering why you would think that the federal law overights state law? I mean I hope it was but it is starting to seem like it isn’t. How do you know what this is true in nj? Thanks
As is always is the case with companies that launch products on Indiegogo, there’s a chance those things never happen. But if you’re in love with the idea and don’t particularly want to roll the dice on a startup, there are plenty of similarly priced portable batteries and solar panels already available on the market, and an abundance of e-bikes at or under Kvaern’s price tag. You might have to do a little comparison shopping if you want to find something that matches the Copenhagen startup’s style, but you’ll certainly be able to ride the sun’s rays a lot sooner.
And let’s not forget the economic advantages of owning an e-bike. The annual cost of running a new family car is, on average, about $9,000 per year. Running an electric bike costs around $400 per year. And while filling a gas tank costs around $30, recharging an electric bike battery costs only about 50 cents. A tank of gas may get you further, but not 60 times further!

Laws governing who can ride electric bikes, and where, vary from state to state. In some places, you can ride cycle paths; in others, you cannot. You may need a license – and even insurance – and there may be age limits.
