You must realize that the United States of America is a Union not a nation. The member states are nations and are the source of “state” power for the USA. I do not believe that we need to have uniform laws on such things as riding a bicycle because there is not a significant amount of interstate bicycle traffic.

If somebody in another state from yours tells you the bike he wants to sell you is legal for you to ride, it’s not very likely he knows all the statutes that apply in every state. Get your own information from official state websites before you start shopping. That way, you will know what rules apply before you buy a bike that is not a “bike” in your state. Pay particular attention to your e-bikes local status as a “motor vehicle” “motorized vehicle” or “biclcyle”. It will make a great deal of difference which one you are when it comes to using multi use trails and paths.

China has experienced an explosive growth of sales of non-assisted e-bikes including scooter type, with annual sales jumping from 56,000 units in 1998 to over 21 million in 2008, and reaching an estimated fleet of 120 million e-bikes in early 2010. This boom was triggered by Chinese local governments’ efforts to restrict motorcycles in city centers to avoid traffic disruption and accidents. By late 2009 motorcycles are banned or restricted in over ninety major Chinese cities. Users began replacing traditional bicycles and motorcycles and e-bike became an alternative to commuting by car. Nevertheless, road safety concerns continue as around 2,500 e-bike related deaths were registered in 2007. By late 2009 ten cities had also banned or imposed restrictions on e-bikes on the same grounds as motorcycles. Among these cities were Guangzhou, Shenzhen, Changsha, Foshan, Changzhou, and Dongguang.
So your motor is limited to a peak of 1490 watts. This is where you have to be careful as a number of e-bike motors are sold not at peak rating but at their sustainable rate. That 1000w rated motor might actually be capable of 2000w and be a violation.
In most jurisdictions, the bikes are limited to 20 mph. Many can be ridden up to 50 miles before running out of electricity and can be recharged in two to four hours. In price, they run from several hundred dollars to many thousands.
Luckily regardless of the laws, I dont hear much about them being enforced anywhere. For example ebikes are completely illiegal in NYC and people still ride them there all the time, and in fact the city has probably the most successful ebike store in the country: nycewheels
The wording is important on this part I think. It says “incapable”. So I think even if you had CA hooked up to it that allowed you to regulate the speed and wattage output, if the overall system was still “capable” of exceeding those limits, then it would not fall under electric assist bike. The RCW also says if you can pedal the bike above 20mph on human power alone, the motor can’t be capable of adding more speed beyond that. In other words it shuts off, or goes into regen?
Some people will want their e-bike to appear like a normal bike just to avoid any possibility of having a problem. To me, this is not needed if you are riding a street legal e-bike. But this brings up a persistent problem in some places. E-bikes that look like gasoline powered scooters. Many riders have encountered police that cannot be convinced that they can fit the legal definition for a bicycle. Whether they are bicycles or not is defined by the local motor vehicle codes. Or, they may not. In some states, there is no such thing as an e-bike defined in the codes. Either way, you can encounter police who either don’t know their e-bike law, or just ticket you because of their opinion about e-bikes that look like scooters. Cops ticket, Judges sort it out later. Looking like a normal bike and staying under the police radar can save you some trouble. If you have a scooter type e-bike, then it’s worthwhile to know the law, and possibly even carry copies of the law that makes your bike a legal bicycle.
Continue reading subsection D. It only applies to state laws that are “more stringent than the Federal law or requirements referred to in subsection A” — then go back to subsection A and see if it says anything at all about the operation of e-bikes. It does not. It only refers to 16 CFR 1500.18 – (“Banned toys and other banned articles intended for use by children.”) and 16 CFR Part 1512 (“REQUIREMENTS FOR BICYCLES”), which has such thrilling subsections as “Bicycle Front Fork Cantilever Bending Test Rig” and “Toe Clearance and Chain Guard Requirements” but says absolutely nothing about what types of roads or paths e-bikes are allowed to be operated upon, etc.
Riding Position: You also may wish to check out an e-bike’s riding position before investing in it. For short trips, the riding position might not make much difference, but for long journeys, the upright “Dutch” style with pulled-back handlebars is very comfortable – particularly for tall riders. The same goes for mountain bike styles, though these bikes are not often designed to actually go off-road.
All of which raises a question: Can electric bicycles help solve big environmental problems? The industry — which is making a push to expand its sales in the U.S. — says e-bicycles will reduce greenhouse gas emissions, air pollution, and traffic congestion, while enabling Americans, two-third of whom are obese or overweight, to become more active. In Europe and China, most electric bicycles are sold to commuters, although it’s not clear whether they are replacing conventional bikes, mopeds, or cars.
I have a pedelec and love it. I have three bikes, and I want to pedal, but when I have a meeting at night that is 7 miles away, I take the e-bike. It is enough of a boost to keep me from wanting to take the car at the end of a long day. It’s fun. Also, the laws on e-bikes continue to change, but it looks like the pedelecs will be classified as bikes, whereas bikes with throttles or self-propelled speeds of more than 20 mph are starting to become classified as “motor” vehicles and requiring registration in some states.
It’s an unfortunate fact of life that as people get older, their sense of balance diminishes. This means that seniors have a higher than average risk of falling when cycling. They may be less likely to do so, however, if the senior-specific Sofie e-bike reaches production.
For some, only the best will do. The next generation of e-bike battery packs is now here with a massive 52 Volts. The Gocycle GS was hotly anticipated as a more affordable version of the G3. The GS is not a tuned down version of the G3. It has mostly the same specs as the G3. We like what Gocycle did with this e-bike. It does away with some of the futuristic features of the G3. We still feel the Gocycle is the bike of the future. It folds, it’s magnesium for light weight, and it was the first bike that didn’t make us dread an empty battery. We simply pedaled back home without struggling. We rode the GS and G3 downtown to meetings well dressed without breaking a sweat.
Foldability: Not all folding e-bikes are small. Some full-size electric bikes with standard 26-inch or 27.5-inch wheels can be folded to fit into compact spaces. Make sure you’re aware of a folding bike’s weight before you buy it, though. “Foldable” doesn’t always mean light.

Lithium manganese batteries are used in the latest Nissan Leaf electric car. It’s claimed they generate more power and last longer. The new Leaf has double the range of its predecessor, but we’ve seen these batteries in very few (and very expensive) e-bikes so far.
The Stromer ST1 Platinum may look less decked out than the other models, but this e-bike is pretty high-tech. It looks like something a Storm Trooper might pilot and has a futuristic computer readout to go with it—showing speed, odometer, trip time, and battery level, among other things. The battery is built into the down tube, and the speed tops out at 28 miles per hour. It also has fender and rack mounts if you want to make it a great commuter bike in the winter and can go up to 55 miles on a single charge.
