HR-727 amended the Consumer Product Safety Act, which falls under Title 15 of the United States Code, which is overall entitled “Commerce and Trade” – so it’s very clear from the context that the federal definition of “low speed electric bicycle” is intended to pertain only to commerce and trade (i.e., importing and selling) of e-bikes. HR-727 was intended to place e-bikes under the jurisdiction of the Consumer Product Safety Commission when it comes to establishing safety requirements for e-bikes imported and sold in the U.S. (as opposed to DOT or NHTSA, which handle such requirements for motor vehicles like cars and trucks). Federal law says nothing about where and how e-bikes may be ridden, thus allowing states and local jurisdictions to set their own rules.
What is it? Back to the definitions, since it is not an electric bike, it CAN be a motor driven cycle. So it is a Moped, and a moped IS a motor vehicle. If I look up the requirements for mopeds in other statutes, I may find my homemade moped will not be legal without lights, turn signals, dot approved tires, valid drivers license needed, etc etc etc. If that is so I’m screwed! ARRRGHHH!

If you have dynamo-powered bicycle lights, you already own an electric-powered bicycle! Consider: as you pump your legs up and down on the pedals, you make the wheels rotate. A small dynamo (generator) mounted on the rear wheel produces a tiny current of electricity that keeps your back safety lamp lit in the dark. Now suppose you could run this process backward. What if you removed the lamp and replaced it with a large battery. The battery would kick out a steady electric current, driving the dynamo in reverse so that it spun around like an electric motor. As the dynamo/motor turned, it would rotate the tire and make the bike go along without any help from your pedaling. Hey presto: an electric bike! It may sound a bit far-fetched, but this is more or less exactly how electric bikes work.

Luckily regardless of the laws, I dont hear much about them being enforced anywhere. For example ebikes are completely illiegal in NYC and people still ride them there all the time, and in fact the city has probably the most successful ebike store in the country: nycewheels
In the theoretical electric bike we considered up above, we had the dynamo/motor driving the back wheel directly, simply by pressing on the tire. Most electric bikes work a different way. They have compact electric motors built into the hub of the back or front wheel (or mounted in the center of the bike and connected to the pedal sprocket). Take a look at the hub of an electric bike and probably you’ll see it’s much fatter and bulkier than on a normal bike. This article seems incorrect. I have read the HR-727 and can’t seem to find anywhere that states the 750 watt 20 MPH limit is only for people selling ebikes. The way it is written seems to imply the law is for riding ebikes.

My State (WV) Laws are similar. Anything with motor is a Moped (requires registration and insurance and that kills a lot of incentive to use one).
